UK Settlement on the Protection Route (ILR)

Overview

Settlement on the Protection Route is the route to Indefinite Leave to Remain (ILR) for people who have been granted refugee status or humanitarian protection in the UK and have completed the required qualifying period.

In general, you must have spent at least 5 continuous years in the UK with refugee status or humanitarian protection, and your protection status must not have been revoked or renounced. You must usually be in the UK when you apply.

If your application is successful, you can usually live, work and study in the UK without time restrictions. You may also be able to apply for British citizenship later, if you meet the nationality requirements.

This article explains who can apply, what evidence is usually needed, why applications are refused, and what to do if your application is unsuccessful.

At Alstern Solicitors, we are expert in refugee and human rights that help clients prepare protection settlement applications carefully and efficiently, with clear advice on eligibility, evidence and refusal risks.

Eligibility / Key Legal Requirements

You may be eligible for settlement on the protection route if you:

  • have spent a continuous period of at least 5 years in the UK with refugee status or humanitarian protection;
  • still have valid refugee status or humanitarian protection that has not been revoked or renounced;
  • are in the UK on the date of application;
  • meet the identity and nationality requirements;
  • have provided the required biometrics;
  • meet the relevant suitability requirements;
  • are applying as a main applicant or as a partner/child dependant where the Immigration Rules allow.

General documents usually needed:

  • passport or travel document;
  • biometric information;
  • evidence of refugee status or humanitarian protection;
  • proof of identity and nationality;
  • evidence of relationship, for partner or child applications;
  • proof that the applicant is in the UK;
  • any documents requested by the Home Office to support the application.

The above information is intended for general guidance only. Every case involves different legal and factual considerations and supporting documents should be carefully prepared to reflect your specific circumstances. Contact Alstern Solicitors for a tailored and up-to-date document checklist designed to strengthen your application and minimise the risk of refusal.

Please note that the eligibility requirements may change following the introduction of the new refugee protection model called ‘core protection’ system. If you claim asylum on or after 2 March 2026, the route to settlement will be significantly different.

Common Reasons for Refusal

A protection settlement application may be refused where:

  • the applicant has not completed the 5-year qualifying period;
  • the applicant’s refugee status or humanitarian protection has been revoked or renounced;
  • the Home Office is not satisfied that the applicant’s protection still continues after the safe return review;
  • the applicant does not meet the suitability requirements;
  • the applicant is not in the UK when the application is made;
  • identity, nationality or relationship evidence is incomplete or inconsistent;
  • the applicant fails to provide biometrics or respond properly to Home Office requests.

Common mistakes include:

  • applying too early;
  • submitting weak or incomplete identity evidence;
  • not addressing travel history properly;
  • failing to explain any changes in personal circumstances;
  • assuming settlement is automatic once 5 years have passed.

Case Study from Alstern Solicitors

Background

The client had refugee status in the UK and wanted to apply for settlement after completing the qualifying period.

Challenge

There were gaps in the evidence of residence and concerns about travel history, which could have affected the application.

How we assist client to achieve success

We reviewed the client’s immigration history, organised the supporting documents, addressed the travel issue clearly, and prepared the application to meet the relevant Immigration Rules. The application was then submitted with a clear and structured evidence bundle.

What Happens if the Application Is Refused?

If your settlement application is refused, the next step depends on the reason for refusal and your current status.

  • If you still require protection, the Home Office may refuse settlement but grant further permission to stay instead.
  • If the refusal involves a human rights issue, you may have a right of appeal.
  • Administrative review is not usually the main remedy for settlement refusals on this route; the correct challenge route depends on the wording of the decision.
  • In some cases, you may be able to make a fresh application if you can provide better evidence or if your circumstances have changed.
  • Judicial review may be relevant in limited cases where there is no adequate appeal route.

Related Routes / Alternatives / Additional Considerations

If you do not qualify for settlement on the protection route, you may need to consider:

  • further permission to stay under the protection route;
  • a family life or private life application, if eligible;
  • another immigration route only if you meet that route’s specific requirements;
  • legal advice before making a new application, especially where protection status, revocation or travel history may be relevant.
